Conditions for Use

Permission will be granted for the use of copies of photographs and other still image material (such as maps, illustrations, etc.) from the West Virginia and Regional History Collection (WVRHC) from the following categories of use: Research (personal), Academic and Non-Profit, and Commercial. Use fees are assessed for any use other than Research (personal). All fees are for one time, non-exclusive use. The WVRHC does not grant open ended permission for future editions or other uses, and never grants exclusive rights. Any additional use of photographs and still image material for the same or different category must be applied for as a separate use. Additional use fees may apply at that time.
Credit will be given using the following credit line:

1. For print publications, crediting of each item is mandatory in all cases, unless an exception is granted in writing.
2. For audio-visual productions, credit can be listed with other sources of illustrations. For printed material accompanying audio-visual productions, credit at the point where the illustration is discussed.
3. For exhibitions, credit within the exhibit area.
4. We reserve the right to double use fees when our images are published without credit.
The West Virginia and Regional History Collection will be given one complimentary copy of any publication or audio-visual production in which our photographs or still images appear. Exceptions may be made for productions of exceptional expense, but must be agreed to and noted on this form.
Users of our photographs and still images assume all responsibility for questions of copyright and invasion of privacy that may possibly arise in their reproduction and use.
In providing reproductions of photographs and still images and authorizing their use, the West Virginia and Regional History Collection does not surrender its right to publish them, or to grant permission to others to do so.
Others must not be permitted to make copies from reproductions of our photographs and still images, or from any facsimiles derived from those reproductions.
Reproductions of our photographs and still images shall not be donated to other individuals or organizations without written permission from the West Virginia and Regional History Collection.
The West Virginia and Regional History Collection reserves the right to limit the number of photographs and still images copied; to restrict the reproduction or use of rare or valuable material; to make special quotations on material involving unusual difficulty in copying; and to charge higher use fees to commercial users.

I acknowledge that I have received, read, and understand "Conditions for Use" as it appears on this form, and agree to comply with all the rules listed therein, and that violation of the rules is grounds for revocation of permission to use the Collections.

Rates are current as of August 2005, but are subject to change.

5 x 7:	$8.00	11 x 14:	$35.00

2. Digital Files (per copy):
For originals with dimensions up to 11 x 17:	$10.00 from an original print, or $5.00 from a digital file
For originals with dimensions greater than 11 x 17:	cost recovery plus $20.00 per hour service charge
Editing of digital files:	$20.00 per hour

3. Slides (per copy): 35mm: $5.00

4. Special Hourly Fee: We reserve the right to charge $20.00 per hour for labor required to process special requests.
